Vietnam: Import and export of films according to the Amending Cinematography Law 2009

The Law Amending and Supplementing a Number of Articles of the Cinematography Law 2009 of Vietnam amends and supplements the regulations on the production, organization of screenings and export of television films of Vietnam Television, approved by the National Assembly on June 18, 2009. One of the notable contents of this Law is the regulation on import and export of films.

Specifically, according to Clause 8 Article 1 of the Law Amending and Supplementing a Number of Articles of the Cinematography Law 2009 of Vietnam amending Point a Clause 1, Clause 3 and Clause 5 Article 30 of the Cinematography Law 2006 of Vietnam, import and export of films are prescribed as follows:

- Organization importing or exporting films shall comply with the following regulations:

+ To-be-exported films must be granted dissemination permits by a competent cinematography state management agency.

To-be-exported films produced by Vietnam Television must have broadcasting decisions issued by the head of Vietnam Television; to-be-exported films produced by television or radio-television stations must be granted dissemination permits by a competent cinematography state management agency.

To-be-exported film tapes and discs must be stuck with control stamps of the Ministry of Culture, Sports and Tourism.

+ Imported films must be those with lawful copyright and not violate the provisions of Article 11 of the Cinematography Law 2006 of Vietnam.

- Film distribution enterprises and other enterprises having business registration for film import and export business must have cinemas to disseminate films.

- Film production enterprises may import and export films under the law on import and export.

- Film projection enterprises may import films for dissemination.

- Television and radio-television stations may export their own films and import films for television broadcasting.

- Non-business units may import films for internal circulation in service of their work; their heads shall take responsibility for the contents, management and use of such imported films.

- Scientific research institutions may import films in service of scientific research in accordance with their respective functions and tasks; their heads shall take responsibility for management and use of imported films.
