Vietnam: How is the weather impact plan assessed?

Specifically, approval for a plan for making impacts on weather prescribed in Article 44 of the Law on hydrometeorology shall be carried out as guided in Article 6 of Circular No. 09/2016/TT-BTNMT of the Ministry of Natural Resources and Environment of Vietnam.

Based on each specific case, the Ministry of Natural Resources and Environment invites representatives of relevant ministries, branches, localities, scientists and experts to participate in evaluating weather impact plans. The appraisal documents of these agencies ensure a detailed and complete assessment of each content as prescribed in Clause 2 Article 44 of the Law on hydrometeorology of Vietnam. There are 02 following cases:

- In case the weather impact plan is appraised and approved without request for modification or supplementation, the Department of Meteorology, Hydrology and Climate Change submits to the Minister of Natural Resources and Environment for approval by the Prime Minister or approved according to authority; in case of non-approval, the Ministry of Natural Resources and Environment shall send a written notice of reason to the planning agency or organization.

- In case the weather impact plan must be revised, the Ministry of Natural Resources and Environment shall send a document with an appraisal report to the agency or organization making the weather impact plan to complete the plan.

After that, the Department of Meteorology, Hydrology and Climate Change helps the Minister of Natural Resources and Environment organize the appraisal of weather impact plans according to regulations; prepare a weather impact plan appraisal report including the following main contents:

+ Relevance of legal bases;

+ Necessity, urgency, feasibility and practical significance of the plan;

+ Conformity of the plan's content with the provisions of the Law on Hydrometeorological and relevant legal documents;

+ The report summarizes appraisal opinions including opinions of relevant agencies, organizations, experts, and scientists.

Note: The maximum appraisal time limit is no more than 30 working days from the date the appraisal dossier-receiving agency receives the complete appraisal request dossier.
