Vietnam: How is the penalty for operating motorbikes exceeding the speed limits by 10 km/h - 20 km/h?

This is a notable content of the Draft Law on ensuring road traffic order and safety, which is submitted to the National Assembly of Vietnam for consideration.

According to the Draft Law on ensuring road traffic order and safety of Vietnam, fines and deduction of points for driving licenses for cars that exceed the prescribed speed from 10 km/h to 35 km/h; mopeds, motorcycles and special-use motorcycles that exceed the prescribed speed from of over 10 km/h to 20 km/h.

Concurrently, this Draft Law also stipulates traffic safety violations that are also applied with the form of fines and deduction of driving license points, specifically as follows:

- Operating a vehicle without a corresponding certificate of vehicle registration or trailer/semi-trailer registration or using an expired certificate of vehicle registration;

- Failing to attach number plates according to regulations; attaching number plates that do not match the vehicle registration papers or attaching number plates not issued by competent authorities;

- Using a Certificate of technical and environmental safety or stamp of technical and environmental safety or Certificate of vehicle registration that is not issued by a competent authority; using a Certificate of vehicle registration that is not consistent with the chassis or engine number;

- Operating a vehicle without a certificate of technical and environmental safety or stamp of technical and environmental safety (if required, except for temporarily registered vehicles) or with one that has expired for 01 month or more;

- Passenger cars (except buses) carrying more than 50% to 100% of the number of people allowed to carry;

- Cars carrying goods exceeding the allowable tonnage by more than 50% to 150%;

- Cars carrying goods with the total weight of the vehicle or the axle load exceeding the allowable load of the bridge or highway by 20% to 150%;

- Violations against regulations on transport of oversized cargo, crawler vehicles, overloaded vehicles, oversized limits of bridges and roads;

- Using warning devices for emergency vehicles on a non-emergency vehicle;

- Installing or using a horn the loudness of which is beyond legal limit on the vehicle; cars installed with lights in front, rear, on the roof, under, one or both sides of the vehicle;

- Cars, tractors, special-use motorcycles with navigation systems that do not comply with technical safety standards; without a decent or functional and conformable brake system; 

- Vehicles manufactured, assembled or modified against the traffic regulations;

- Vehicle beyond its maximum service life (if limited);

- Temporarily registered vehicle beyond its temporary operational period; operating a restricted vehicle beyond its permissible operating area;

- Motorcycles and mopeds carrying 03 or more people; letting the sidestand or other object touching against the road while running; release both hands while operating the vehicle; steering with the legs; sitting on one side to operate the vehicle; lying on the seat while operating the vehicle; swapping positions while operating the vehicle; turning the whole body to the back or wearing a blind fold while operating the vehicle; running on one wheel (or two wheel if the vehicle is a motor tricycle); exceeding the speed limits in a group of 02 vehicles or more.
