Vietnam: How is the certificate of eligibility for temporary import issued?

Circular No. 11/2017/TT-BCT, which was issued on July 28, 2017 by the Ministry of Industry and Trade of Vietnam, specifies the procedures for issuance of certificates of eligibility for temporary import.

According to Circular No. 11/2017/TT-BCT of the Ministry of Industry and Trade of Vietnam, the procedures for issuance of certificates of eligibility for temporary import are prescribed as follows:

- The applicant shall send an application for the certificate of eligibility for temporary import as prescribed in Article 10 of this Circular to the Ministry of Industry and Trade by post  (Address: 54 Hai Ba Trung, Hoan Kiem district, Ha Noi city).

- In case of invalid application, within 5 working days from the day on which the application is received, the Ministry of Industry and Trade shall request the applicant in writing to provide the additional documents.

- Within 7 working days from the day on which the valid application for the certificate of eligibility for temporary import of frozen foods is received, the Ministry of Industry and Trade shall inspect or authorize the Department of Industry and Trade of the province in which the applicant’s warehouses are located to inspect the conditions of warehouses. Within 7 working days from the day on which the result of the warehouse inspection is available, the Ministry of Industry and Trade shall consider issuing the certificate of eligibility for temporary import to the applicant.

- In case of goods subject to excise taxes or used goods, within 7 working days from the day on which the valid application is received, the Ministry of Industry and Trade shall consider issuing the certificate of eligibility for temporary import to the applicant.

- If relevant documents included in the application for the certificate of eligibility for temporary import must be verified, the time limit for application processing will be extended by the period over which the documents are verified.

- The Ministry of Industry and Trade shall send a written explanation to the applicant if the application is rejected.

- The certificate of eligibility for temporary import or written explanation of the Ministry of Industry and Trade shall be sent by post to the applicant through the address specified in the application.
