Vietnam: How are the standards for persons doing legal works regulated?

On July 04, 2011, the Government of Vietnam issued Decree No. 55/2011/ND-CP prescribing functions, tasks, powers, and organizational structure of the organization performing legal works.

According to Article 12 of Decree No. 55/2011/ND-CP of Vietnam’s Government, standards and regulations for persons doing legal works are specified as follows:

1. Standards for persons doing legal works

- Officials doing legal works, as stipulated in Clause 1 Article 11 of this Decree, must be officials from the specialist rank or equivalent, with a minimum of a bachelor's degree in law.

- Public employees doing legal works, stipulated in Clause 1 Article 11 of this Decree, must be public employees with professional titles and a minimum of a bachelor's degree in law.

- The head of the organization performing legal works must have a minimum of a bachelor's degree in law and at least five years of direct experience in legal works.

- Based on the standards for officials and public employees doing legal works specified in points a and b of this clause, the Minister of Defense and the Minister of Public Security shall provide specific guidance on the standards for persons doing legal works in the people's military and public security forces.

2. Officials and public employees doing legal works specified in Clauses 1, 2 and 3 Article 11 of this Decree shall receive profession-based allowances.

The Ministry of Justice, in coordination with the Ministry of Home Affairs and the Ministry of Finance, shall develop and submit to the Prime Minister for approval the regulations on profession-based allowances for persons doing legal works.

3. State-owned enterprises may apply the standards and regulations for persons doing legal works specified in Clause 1 and Clause 2 of this Article to select, arrange, utilize, and determine the regime for persons doing legal works.
