Vietnam: How are persons participating in the organization of the recruitment exam for officials and public employees who violate the rules and regulations?

Circular No. 6/2020/TT-BNV of the Ministry of Home Affairs of Vietnam guides the handling of violations for officials and public employees participating in the exam organization and other related individuals who violate the rules and regulations as follows:

- Persons participating in the organization of the recruitment period for officials and public employees, the examination for promotion of officials ranks, promotion of professional titles of public employees (members of the Council, members of the assisting sections of the Council, members of the Secretariat) are officials or public employees who commit acts of violating the rules and regulations, in addition to being suspended from work in service of the recruitment period for officials and public employees, examination for promotion of officials ranks, promotion of civil servants' professional titles, he/she is also considered for disciplinary action in accordance with the law on officials and public employees.

- Persons participating in the organization of the recruitment period for officials, public employees, officials promotion exams, promotion for public employees' professional titles and other related people who are not officials or public employees, if he/she commits regulations, depending on the nature and extent of being considered, decided by the currently managing agency or unit or reported to the competent authority for consideration and decision on the termination of the contract being signed.

- If the person participating in the organization of the recruitment examination for officials and public employees, the examination for promotion of officials ranks, the promotion of professional titles of public employees and other relevant persons, violates the internal rules and regulations, the head of the competent agency and management unit does not arrange to take on tasks related to the organization of the recruitment examination for officials and public employees, the examination for promotion to civil servant ranks, promotion to public employees' professional titles from 01 year to 03 years from the time the competent agency or unit issues a decision on disciplinary action for the above violation.

In case officials and public employees do not participate in organizing the recruitment examination for officials and public employees, taking exams for promotion of officials ranks or promotion to public employees' professional titles, but have acts such as: taking the exam on behalf of other person; transfering the exam papers out; giving answers to candidates; giving false information that adversely affects the exam; causing disorder at the examination area, they will be disciplined according to the provisions of the law on officials and public employees.
