Vietnam: Guidelines for establishment of the council to recruit students from ethnic minorities

On December 08, 2020, the Government of Vietnam issued the Decree No. 141/2020/NĐ-CP on regulations on the recruitment regime for pupils and students of ethnic minorities.

According to Article 8 of the Decree No. 141/2020/NĐ-CP of Vietnam’s Government, the recruitment process for ethnic minority students is regulated as follows:

- The Election Council (hereinafter referred to as the Council) is established by the President of the People's Committee of the province to assist the President of the People's Committee of the province in recruiting;

- Members of the Council include: The Chairman of the Council is the President or Vice President of the People's Committee of the province; Standing Vice Chairman of the Council is the Director of the Department of Education and Training; The Vice Chairman of the Council is the Director of the Department of Home Affairs and the Head of the Provincial Committee for Ethnic Minorities; other members include: Representatives of leaders of the Department of Labor - Invalids and Social Affairs, Department of Planning and Investment, Department of Finance, departments and branches related to the field to be considered for recruitment, the Front Provincial Fatherland;

- Tasks of the council: to appraise documents, to consider selecting and proposing a list of qualified people to attend school according to the recruitment regime according to the assigned quota. The chairperson of the council is responsible for submitting to the chairperson of the provincial-level People's Committee for approval the list of people who can continue to attend school according to the election regime;

- Working principle of the council: the council works on the principle of collective and makes decisions by majority. In case the number of opinions is equal, the decision shall be made according to the opinion of the Chairman of the Council;

- Notification of approval results: Within 05 working days after the date of selection, the election council must submit to the President of the provincial People's Committee for approval the list of successful candidates to attend the school according to the election regime. The Council shall publicly announce the election results immediately after they are approved on the mass media, on the website or portal, and publicly post them at the head office of the Department of Education and Training.
