Vietnam: Guidance on project management entrustment

This is a notable content specified in Circular No. 16/2016/TT-BXD of the Ministry of Construction of Vietnam providing guidance on application of a number of articles of the Decree No.59/2015/ND-CP of Vietnam’s Government on construction project management.

Specifically, according to Circular No. 16/2016/TT-BXD of the Ministry of Construction of Vietnam, procedures for project management entrustment are as follows:

- The investor may submit a request for project management entrustment as a preliminary negotiation to the field-based or area-based project management board (PMB) where the project is located. The request shall include project description, scope of work and conditions.

- According to the preliminary negotiation, the investor shall request the investment decision-maker to consider approving the entrustment of project management to the field-based or area-based PMB;

- The investor shall negotiate and sign the entrustment agreement under regulations of laws on construction.
