Vietnam: Guidance on application for appraisal of the reservoir operation procedure

According to Article 12 of the Decree No. 114/2018/NĐ-CP of Vietnam’s Government, the applicant shall submit the application directly or by post to the receiving authority. The application includes:

- An application form for appraisal

- The draft reservoir operation procedure;

- A report on the result of technical calculation;

 - A map of reservoir status;

- Opinions in writing from relevant agencies;

- Other relevant documents.

Besides, authorities that receive applications and appraise reservoir operation procedures are stipulated as follows:

- Irrigation Department General shall receive applications and appraise procedures for operation of reservoirs which will be approved by the Ministry of Agriculture and Rural Development.

- The Industrial Safety Techniques and Environment Agency shall receive applications and appraise procedures for hydroelectric reservoir operation which will be approved by the Ministry of Industry and Trade.

- The Department of Agriculture and Rural Development shall receive applications and appraise procedures for irrigational reservoir operation which will be approved by provincial People's Committees.

- The Department of Industry and Trade shall receive applications and appraise procedures for hydroelectric reservoir operation which will be approved by provincial People’s Committees.

- State management agency for irrigation affiliated to district-level People's Committees shall receive applications and appraise procedures for irrigational reservoir operation which will be approved by district-level People's Committees.
