Recently, the Ministry of Public Security of Vietnam has issued the Circular No. 71/2012/TT-BCA on the assignment of responsibilities and coordination relationship between the People's Police units in the implementation of community reintegration work for those who have completed their prison sentences.
According to Article 6 of the Circular No. 71/2012/TT-BCA of the Ministry of Public Security of Vietnam, responsibilities for the exchange of information related to the work of ensuring community reintegration for persons who have finished serving prison sentences are as follows:
- General Department VIII is responsible to:
+ Direct prisons and detention camps under the Ministry of Public Security; the criminal judgment execution agency and detention center of the provincial-level police department shall notify the result of serving the prison sentence, additional punishment (if any) and other relevant necessary information as prescribed in Clause 1 Article 40 of the Law on Execution of Criminal Judgments of Vietnam in order to have a plan to manage, educate and help them reintegrate into the community;
+ Send the list of prisoners who have been unanimously requested amnesty by the interdisciplinary appraisal team of the Amnesty Advisory Council to the provincial police to proactively plan to receive, manage, educate and help them reintegrate into the community;
+ Every 6 months and 1 year, notify the General Department and Department V28 the results of the implementation of community reintegration work of units and localities nationwide.
- General Department VII is responsible to:
+ Direct forces of Police for administrative management of social order and local police every 6 months and 1 year to summarize and evaluate the current situation of people who have completed their imprisonment sentences; the number of people who do not return to their places of residence, the number of people who have finished serving their prison sentences from other places to reside; the number of people who re-offend and violate the law; coordinate with the Criminal Judgment Execution and Judicial Assistance Police Department (PC81), the Division for the Construction of the All-People Movement to Protect Fatherland Security (PV28) in summarizing and advising the provincial-level Public Security to report to the Ministry of Public Security of Vietnam (via General Department VIII);
+ Exchange information with General Department VIII and Department V28 on the results of receiving, managing, educating and helping people who have completed prison sentences to reintegrate into the community, according to the functions and tasks of the Police for administrative management of social order.
Department V28 is responsible to: Periodically, annually synthesize and notify the General Department of VII and VIII of the results of building advanced models and individuals in the work of mobilizing the entire population to participate in receiving, educating and helping those who have finished serving their prison sentences, those who are granted special amnesty will re-integrate into the community.
