Vietnam: Forging documents in dossier for appointment of notary public shall be fined severely

According to Clause 3 Article 1 of Decree No. 67/2015/ND-CP of Vietnam’s Government amending Article 11 of Decree No. 110/2013/ND-CP, a fine of between VND 7,000,000 and VND 10,000,000 shall be imposed for the acts of forging documents in dossier for appointment or reappointment of notary public. Concurrently, the violator shall be forced to destroy fake documents and return illegal profits gained from performing this act.

The above fine is also imposed for the acts of “forging documents in dossier for establishment, operation registration, and modification of content of operation registration of notary office”.

Besides, Decree No. 67/2015/ND-CP also stipulates penalties for violations of regulations on dossiers and procedures for requesting appointment and reappointment of notaries and issuance of notary cards; application for establishment, registration of operation, request to change the content of operation registration, practice registration for notaries of notary offices, specifically as follows:

- A caution or fine of between VND 500,000 and VND 1,000,000 shall be imposed for one of the acts as follows:

+ Modifying, erasing or falsifying the contents of papers issued by the competent authority in dossier for requesting appointment and reappointment of notaries and issuance of notary cards;

+ Modifying, erasing or falsifying the content of documents and materials issued by the competent authority in the dossier for establishment, registration of operation, request to change the content of operation registration, practice registration for notaries of notary offices.

- A fine of between VND 3,000,000 and VND 7,000,000 shall be imposed for one of the acts as follows:

+ Using false documents in the dossier for appointment or reappointment of notary public;

+ Using false documents in dossier for establishment, registration of operation, request to change the content of operation registration, practice registration for notaries of notary offices.

+ Failing to confirm the right time to perform legal work, the time and result of apprenticeship of notary public to propose the appointment of notary public.
