Vietnam: Forging a negotiable instrument in any form is strictly prohibited

The Law on negotiable instruments 2005 of Vietnam was promulgated on November 29, 2005, consisting of 6 chapters and 83 articles. There are certain acts that are strictly prohibited specified in this Law.

Specifically, according to Article 15 of the Law on negotiable instruments 2005 of Vietnam, prohibited acts include:

One, forging a negotiable instrument, amending or erasing items on a negotiable instrument.

Two, deliberately assigning or accepting assignment [of a negotiable instrument], or presenting for payment a negotiable instrument which was forged, amended or the items of which were erased.

Three, signing a negotiable instrument without authorization or forging the signature on a negotiable instrument.

Four, deliberately assigning a negotiable instrument when aware that the period for payment of such negotiable instrument has expired or such negotiable instrument was dishonored by non-acceptance or by non-payment or has been notified as lost.

Five, deliberately drawing a negotiable instrument without the ability to pay it.

Six, deliberately drawing a cheque after the right to draw cheques has been stopped.
