Vietnam: Fines shall be imposed on the following educational institutions if they commit administrative violations

This is one of the important contents expected to be promulgated by Vietnam’s Government in the Draft Decree on penalties for administrative violations pertaining to education.

The Government has listed subjects who will be administratively fined if there are violations in the field of education. These subjects are clearly stated in Article 2 of the Draft Decree on penalties for administrative violations pertaining to education, including:

- Pre-school educational institutions; general education institutions; continuing education institutions; secondary schools and colleges that train groups of teachers; higher education institutions; academies and institutes established by the Prime Minister under the provisions of the Law on Science and Technology are allowed to provide doctoral training;

- Specialized schools and other educational institutions; representative office of foreign education in Vietnam; branches of foreign educational institutions in Vietnam; educational institutions belonging to political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations other than those specified at Point a, Clause 1 of this Article and organizations being juridical persons other than educational institutions implementing preschool and general education programs; training at intermediate and college levels in the field of teachers; training at university, master and doctoral levels; training and retraining programs to improve professional qualifications and skills under the state management of the Ministry of Education and Training;

- Education quality accreditation organizations, overseas study consulting service business organizations and service providers associated with educational activities under the state management of the Ministry of Education and Training (hereinafter referred to as educational service providers);

- Vocational education institutions carry out joint training at university level.

Note: This Decree does not apply to cadres, civil servants and public employees who commit administrative violations while performing their assigned duties or tasks and state agencies committing violations within their assigned state management tasks.

Compared with Decree No. 138/2018/NĐ-CP of Vietnam’s Government, which only stipulates regulated entities including “Vietnamese organizations and individuals; foreign organizations and individuals committing the violation pertaining to education within Vietnam’s territory”, the Draft Decree has a breakthrough that is listing organizations operating in the field of education. This will help partly answer questions from people about related issues.
