The Government of Vietnam issued Decree No. 119/2017/NĐ-CP on penalties for administrative violations against regulations on standards, measurement and quality of goods, which specifies fines for violations against regulations on use of barcodes as follows:
A fine of from VND 6,000,000 to VND 10,000,000 shall be imposed for any of the following violations:
- Use of the barcode using Vietnam code (893) without grant of rights to use barcodes;
- Use of revoked barcodes;
- Sale or transfer of granted barcodes.
A fine of from VND 10,000,000 to VND 20,000,000 shall be imposed for any of the following violations:
- Use of foreign barcodes to print on produced/processed/packaged/extracted goods in Vietnam without a written permission given by a foreign competent authority or an organization possessing such barcodes;
- Use of signs that make it difficult to distinguish from barcodes of a competent state authority and the GS1.
A fine of from VND 20,000,000 to VND 50,000,000 shall be imposed for any of the following violations:
- Providing or using source of data on barcodes not in line with those of the competent state authority and the GS1;
- Provide false information about the owner or user of legal GS1 barcodes;
- Developing and providing services, solutions and applications based on barcodes of the competent state management.
