Vietnam: Establishment and dissolution of special-use forest management board

On November 16, 2018, the Government of Vietnam issued Decree No. 156/2018/NĐ-CP, which specifies the establishment and dissolution of a special-use forest management board.

According to Decree No. 156/2018/NĐ-CP of Vietnam’s Government, a special-use forest management board shall be established in accordance with the law.

The organizational structure of the special-use forest management board includes:

- The special-use forest management board has a director and deputy directors.

For a special-use forest with a Forest Protection Department, the Director of the Management Board is concurrently the Head of the Forest Protection Department.

- Depending on specific conditions, the Special-use Forest Management Board may organize up to the following units: Forest Protection Department; Organization and Administration; Financial Planning Division; Department of Science and International Cooperation; Marine and Wetland Conservation Division for special-use forests with marine and inland wetland conservation components; Center for Environmental Education and Forest Environmental Services; Center for the rescue, conservation and development of organisms; Specialized forest protection force.

- The special-use forest management board is entitled to actively implement the labor contract regime in accordance with current regulations of the State, in which priority is given to receiving local workers. The contract salary is paid by the State according to the current regime.

Moreover, Decree No. 156/2018/NĐ-CP also stipulates the authority to establish a special-use forest management board as follows:

- The Minister of Agriculture and Rural Development shall decide to establish a special-use forest management board under the direct management of the Ministry.

- Presidents of provincial-level People's Committees shall decide to establish management boards of special-use forests under local management.

The special-use forest management board shall be dissolved in the following cases:

- The special-use forest no longer meets the criteria for forest classification.

- Change the type of special-use forest to another type of forest.

- The agency that decides on the establishment of a special-use forest management board is competent to decide on the dissolution of the special-use forest management board and organizes settlement of post-dissolution issues in accordance with law.
