On July 29, 2013, the Government of Vietnam issued Decree No. 86/2013/NĐ-CP on the business of prize-winning electronic games for foreigners.
According to Article 38 of Decree No. 86/2013/NĐ-CP of Vietnam’s Government, a fine of between VND 90,000,000 and 100,000,000 is imposed on enterprises that tamper with or erase their business eligibility certificates. Concurrently, fines for violations of regulations on management and use of business eligibility certificates are as follows:
- A fine of between VND 130,000,000 and 150,000,000 is imposed on enterprises that lease out, lend or transfer their business eligibility certificates.
- A fine of between VND 90,000,000 and 100,000,000 is imposed on persons who conduct the business of prize-winning electronic games without business eligibility certificates. A fine doubling this fine level is imposed on organizations and units that commit these violations.
Besides, Decree No. 86/2013/NĐ-CP also specified additional sanctions for these violations as follows:
- Deprivation of the right to use business eligibility certificates for between three (3) and six (6) months, for administrative violations which enterprises tamper with or erase their business eligibility certificates;
- Deprivation of the right to use business eligibility certificates for twenty four (24) months, for administrative violations which enterprises lease out, lend or transfer their business eligibility certificates.
- Forcible refund of all earnings from administrative violations.
