Vietnam: Dossiers for social insurance benefits for military servicemen

On October 29, 2020, the Ministry of Defense of Vietnam issued Circular No. 136/2020/TT-BQP providing guidance on dossiers, procedures, and responsibilities related to the settlement of social insurance benefits within the Ministry of Defense.

Article 4 of Circular 136/2020/TT-BQP prescribes the documents, number of documents for social insurance benefit claims, and social insurance books for military personnel; cryptographic workers receiving the same salary as military personnel; national defense officials, workers and public employees under the Ministry of National Defense; contracted labor in agencies, units, businesses under the Ministry of National Defense, as follows:

  • Employees, relatives of employees, employers, individuals, organizations involved in providing, declaring, confirming, and compiling dossiers must record fully, accurately, truthfully, with proper authority, and be legally responsible for the contents declared and confirmed.
  • Documents for resolving social insurance benefit claims must be complete in quantity, standardized in forms, and managed and stored according to legal regulations on filing and storage.
  • The document number for retirement, lump-sum social insurance, occupational accident, occupational disease, and survivor benefit claims is the social insurance number (social insurance book number).
  • The social insurance book of an employee, after resolving retirement, survivor benefits, or lump-sum social insurance, is stored as prescribed at the Ministry of National Defense Social Insurance.

Moreover, regarding the form templates for resolving social insurance benefit claims of military personnel; cryptographic workers receiving the same salary as military personnel; defense public officials, workers and employees under the Ministry of National Defense; contracted labor in agencies, units, businesses under the Ministry of National Defense, it is prescribed as follows:

  • Employees, relatives of employees, employers, organizations, and individuals involved should base their actions on the form templates guided in the list issued with this Circular.
  • Application forms, declaration forms, and official letter forms guided in the list issued with this Circular are provided free by the Ministry of National Defense Social Insurance or directly by the employers responsible for resolving social insurance benefits for employees and their relatives, or can be printed, copied, typed, or handwritten by employees and their relatives according to the prescribed form content.
  • Hospital discharge papers, birth certificates, social insurance leave certificates, pregnancy leave certificates, certificates of insufficient health for child care after childbirth or adoption (in cases where the mother hires a surrogate), and medical record summaries are provided by healthcare establishments according to the provisions of Circular 56/2017/TT-BYT dated December 29, 2017, by the Minister of Health, detailing the implementation of the Law on Social Insurance and the Law on Occupational Safety and Hygiene in the field of healthcare.
