Vietnam: Dossiers for maternity benefits for female military servicemen

Recently, the Ministry of Defense of Vietnam issued Circular No. 136/2020/TT-BQP providing guidance on dossiers, procedures, and responsibilities related to the settlement of social insurance benefits within the Ministry of Defense.

According to Article 9 of Circular 136/2020/TT-BQP, the dossier for resolving maternity benefits is regulated as per Article 101 of Social Insurance Law; clauses 1, 2, 3, 4, 5 of Article 7 of Decree 33/2016/ND-CP dated 10/05/2016 by the Government detailing and guiding the implementation of certain articles of the Social Insurance Law on compulsory social insurance for military personnel, public security personnel, and persons engaged in cipher work paid equally to military personnel; Articles 15, 18, 21 of Circular 56/2017/TT-BYT are to be implemented as follows:

* For female employees (including surrogate mothers) who visit prenatal care, miscarriage, abortion, aspiration, stillbirth, or pathological abortion and employees who undergo contraceptive measures

  • In cases of inpatient treatment: The original or a copy of the discharge paper of the employee; in case of referral for medical examination and treatment during inpatient treatment, there must be an additional copy of the referral paper or transfer paper.
  • In cases of outpatient treatment: The original social insurance leave certificate; or discharge paper with a doctor's or medical staff's prescription for additional rest after inpatient treatment.

* For female employees currently contributing to social insurance who give birth or for the husband/caretaker in cases where the mother dies or the child dies after birth, or when the mother faces risks after giving birth and is not healthy enough to take care of the child, the dossier includes:

  • In case of childbirth: A copy of the birth certificate or birth extract or a copy of the birth record.
  • In case the child dies after birth, in addition to the documents guided at point a of this section, there must be: A copy of the death certificate or death extract or a copy of the death notice of the child. If the child dies immediately after birth and the birth certificate has not been issued, it can be replaced by an extract or a summary of the medical record or the mother's discharge paper showing the child's death.
  • In case the mother dies after birth, in addition to the documents guided at point a of this section, there must be: A copy of the mother's death certificate or death extract.
  • In case the female employee has to leave work to rest during pregnancy as prescribed in clause 3 of Article 31 of the Social Insurance Law, the dossier includes: A copy of the discharge paper or a summary of the medical record showing the need for pregnancy rest (for inpatient cases) or the original social insurance leave certificate showing the need for pregnancy rest (for outpatient cases) or a medical examination council report (for cases requiring a medical examination council).
  • In case the mother is not healthy enough to take care of the child after birth, in addition to the documents guided at point a of this section, there must be: The medical examination council report of the mother (for cases requiring a medical examination council).
