Vietnam: Documentation for recognizing an ad hoc judicial expertise performer

On November 16, 2020, the State Bank of Vietnam issued Circular No. 14/2020/TT-NHNN regulating judicial expertise in the field of currency and banking.

According to Article 9 of Circular 14/2020/TT-NHNN, before October 31st every year, the head of the unit under the State Bank (excluding the Director of the State Bank’s provincial/central city branches) must review, select, and create a list of qualified individuals as specified in Clause 2, Article 5 of this Circular. The list must be submitted to the Personnel Department to present to the Governor of the State Bank for recognizing ad hoc judicial expertise performer. The documentation includes:

  • Written proposal for recognizing ad hoc judicial expertise performer for an individual from the head of the unit under the State Bank where the individual is currently working;
  • A proposed list of individuals for recognition of judicial expertise, including at minimum the following information: full name; date, month, and year of birth; current workplace; professional qualification; specialized training and continuing education fields; professional experience (in months); judicial expertise experience (in terms of the number of cases participated in);
  • Documentation as prescribed in points b, c, d, Clause 1, Article 6 of this Circular;
  • In cases where the individual does not have a university degree, in addition to the documentation as prescribed in points b, c, d, Clause 1, Article 6 of this Circular, there must be a certificate from a legally recognized training institution certifying that the individual has undergone in-depth training in the fields specified in Article 3 of this Circular.

Within a maximum of 7 days from the date of receipt of valid documentation, the Personnel Department must present to the Governor of the State Bank a decision on recognizing ad hoc judicial expertise performer. In case of rejection, the Personnel Department must send a written response to the proposing unit detailing the reasons.

Note: The State Bank’s provincial/central city branches must review, select, and create a list of qualified individuals as specified in Clause 2, Article 5 of this Circular. They must create documentation as prescribed in points b, c, d, Clause 1 of this Article and decide on recognizing ad hoc judicial expertise performer. The decision recognizing judicial expertise must be sent to the Personnel Department before November 20th every year.
