Vietnam: Documentation for individuals proposed for recruitment as officials

On November 27, 2020, the Government of Vietnam issued Decree No. 138/2020/ND-CP on recruitment, utilization, and management of officials.

Article 18 of Decree 138/2020/ND-CP stipulates the documentation for individuals proposed for recruitment as officials as follows:

1. The official's résumé as per current regulations, prepared no later than 30 days before the submission date, and certified by the agency, organization, or unit where the individual works;

2. Copies of diplomas, certificates as required by the job position;

  • If the proposed individual has a graduation diploma with standardized outputs in foreign languages or computer skills as required for the job position, they are not required to submit a foreign language or computer certificate.
  • If the proposed individual meets the criteria for exemption from the foreign language or computer test as stipulated in Clause 1, Article 8 of this Decree, they do not need to submit foreign language or computer certificates.

3. Health certificate issued by a competent medical authority no later than 30 days before the submission date;

4. Self-assessment report of the proposed individual on political qualities, ethical qualities, professional qualifications and skills, work achievements, certified by the head of the agency, organization, or unit where the individual works.

Additionally, Article 18 of Decree 138/2020/ND-CP also stipulates that when receiving cases as per points a, b, and c, Clause 1, Article 18 of Decree 138/2020/ND-CP for non-management or non-leadership positions, the head of the agency managing the official must establish an Examination and Assessment Council. The composition of the Examination and Assessment Council is as per Clause 1, Article 7 of Decree 138/2020/ND-CP. The duties and powers of the Examination and Assessment Council:

  • Examine the standards, conditions, diplomas, certificates, certifications of the proposed individual as required by the job position;
  • Organize assessments of general knowledge and professional qualifications of the proposed individual;
  • Report the examination and assessment results to the head of the agency managing the official.

The examination content must be based on the requirements of the job position to be filled. The assessment form can be interviews, written tests, or a combination of both. The Examination and Assessment Council is responsible for creating the assessment content, proposing the form and method for determining assessment results appropriate to the job position's requirements, and reporting to the head of the agency managing the official for consideration and decision before conducting the assessment. The Examination and Assessment Council operates on a collective principle, making decisions by the majority; in the event of a tie, the decision follows the vote of the Council President. The Examination and Assessment Council disbands after completing its task.

Note: Do not appoint individuals who have relationships as parents, siblings of the incoming official or their spouse; the spouse, biological or adopted children of the incoming official; or individuals currently undergoing disciplinary actions or executing disciplinary decisions as members of the Examination and Assessment Council.
