Vietnam: Disciplinary process of party members under the jurisdiction of the Central Party Committee, the Politburo, and the Secretariat

Recently, Hanoi issued the Procedure for reviewing and implementing disciplinary measures against party organizations and members under the jurisdiction of the Central Party Committee's Executive Committee, the Politburo, and the Secretariat.

On June 6, 2024, the Politburo of Vietnam issued Decision 165-QD/TW regarding the Procedure for reviewing and implementing disciplinary measures against party organizations and members under the jurisdiction of the Central Party Committee's Executive Committee, the Politburo, and the Secretariat.

(1) PREPARATION STAGE

- The Central Inspection Committee submits to the Politburo, Secretariat (through the Central Party Office) the case file which includes: Proposal, report recommending disciplinary action against the violating party organization, member, and relevant documents.

- The Central Party Office sends copies of the case file submitted by the Central Inspection Committee to members of the Politburo, members of the Secretariat; the case file submitted by the Politburo to members of the Central Party Executive Committee according to the Working Regulations.

- The Standing Secretariat assigns a member of the Politburo or Secretariat to hear the violating party organization or member's opinion before organizing a meeting to review disciplinary action. If the violating member is a member of the Politburo or Secretariat, the General Secretary or the Standing Secretary hears the member's opinion.

(2) PROCEEDING STAGE

(2.1) The meeting between the Politburo and the Secretariat for reviewing and deciding on disciplinary actions

* Participants

  • The Politburo or the Secretariat.

  • Representatives of the Central Inspection Committee, Central Organization Committee, Central Party Office.

  • If necessary, representatives of the violating party organization, member, and the organization managing the member concerned are invited.

* Review and decision procedures

  • The representative of the Central Inspection Committee presents the proposal and report recommending disciplinary action.

  • The representative of the violating party organization or member presents their opinion, the organization with the violating member comments; if absent, a representative of the Central Party Office presents the self-criticism report of the violating organization or member and related opinions (if any).

  • The assigned member of the Politburo or Secretariat who met with the violating organization or member reports on their meeting and discussion.

  • The meeting discusses, votes on a disciplinary measure, or votes to recommend the Central Party Executive Committee to review and implement disciplinary action as per regulations.

If the Politburo or Secretariat recommends the Central Party Executive Committee to review and implement disciplinary action, the Central Inspection Committee coordinates with the Central Party Office to prepare the case file for the Politburo to submit to the Central Party Executive Committee.

If the Politburo or Secretariat decides not to implement disciplinary action, the Central Party Office notifies in writing the Central Inspection Committee and the concerned party organization or member.

(2.2) The meeting of the Central Party Executive Committee for reviewing and deciding on disciplinary actions

* Participants

  • The Central Party Executive Committee.

  • Representatives of the Central Inspection Committee, Central Party Office, Central Organization Committee, and relevant party committees.

* Review and decision procedures

  • The representative of the Politburo reads the proposal and report recommending disciplinary action.

  • The representative of the violating party organization or member presents their opinion (if the violating member is a member of the Central Party Executive Committee, or the head of the violating organization is a member of the Central Party Executive Committee, they attend the meeting).

  • The meeting discusses and votes on the disciplinary measure by secret ballot.

If the Central Party Executive Committee decides not to implement disciplinary action, it delegates the Politburo, Secretariat to notify in writing the concerned party organization or member.

(3) CONCLUSION STAGE

- The Central Inspection Committee coordinates with the Central Party Office to assist the Central Party Executive Committee, Politburo, and Secretariat in issuing the decision on disciplinary action or notification of no disciplinary action.

- The Politburo or Secretariat implements the disciplinary decision, notifies the concerned party organization or member and related individuals.

- The Central Inspection Committee completes the review, implements disciplinary action and transfers the file to the Central Party Office for archiving.

- The Central Party Executive Committee, Politburo, Secretariat assigns the Central Inspection Committee to monitor, urge, inspect, and supervise the compliance of the concerned party organization and member with the disciplinary decision.
