This is a notable content of the Decree No. 97/2015/NĐ-CP on management of position holders in wholly State-owned one-member limited liability company issued by the Vietnam’s Government on October 19, 2015.
According to Article 24 of the Decree No. 97/2015/NĐ-CP of the Vietnam’s Government, in each 5-year period, the planning is only developed once. At the beginning of the second year of the period, the planning for the following period is formulated. Concurrently, every April, the Board of Members and the President of the company conduct a review of the plan to consider and add new factors to the plan and remove from the plan those who no longer meet the standards, conditions, and regulations of the planning title. The process of adding new personnel to the planning is as following:
- Pursuant to planning plans already approved by competent authorities; based on the requirements and tasks of the corporation or company; based on the results of the annual assessment of the enterprise's managers and employees, the staffing agency shall introduce a list of personnel expected to supplement the planning, including the following information: full name; date of birth; home town; date of entering the Party; qualification; political theory level; English level; positions, ranks of public employees or professional titles of public employees; agency or unit working.
- The body advising on personnel organization shall report to the Members' Council and the company's president a list of expected additional personnel.
- The Members' Council meets to introduce additional personnel; The Members' Council and the company's President shall decide on the list of personnel to be added to the master plan and collect written opinions from the committees of the same level. In case the local party committee is the superior level of the party committee of a corporation, corporation or company, the written opinion of the local party committee shall be obtained.
- The Members' Council holds a meeting to announce the opinions of the committee, discuss and vote by secret ballot to decide on new personnel to be added to the master plan for each management title. Those who are approved by more than 50% of the total number of members attending the meeting may decide or submit to competent authorities for consideration and addition to the planning;
