From January 01, 2021, when the Decree No. 135/2020/NĐ-CP officially takes effect, the retirement age of employees will increase year by year. How will the retirement age of employees increase in accordance with Vietnam’s regulations?
According to the provisions of Clause 2 Article 169 of the Labor Code 2019 of Vietnam specified in Article 4 of the Decree No. 135/2020/NĐ-CP, since January 01, 2021, the retirement age of employees under ordinary working conditions are 60 years 3 months for male employees and 55 years 4 months for female employees; and the age increases by 3 months for male employees each successive year until he reaches 62 in 2028 and increases by 4 months for female employees each successive year until she reaches 60 in 2035. To be specific:
- Retirement age of female employees under ordinary working conditions
- Retirement age of male employees under ordinary working conditions
Thus, officially from 2021, the retirement age of male employees is 60 years 3 months (an increase of 3 months compared to the provisions of the Labor Code 2012), the retirement age of female employees is 55 years 4 months (an increase of 4 months compared to the provisions of the Labor Code 2012). However, this age will gradually increase according to the roadmap to 2028 and 2035.
