Vietnam: Contents of specialized inspection in the field of domestic investment and foreign investment

Recently, the Government of Vietnam issued Decree No. 216/2013/ND-CP on the organization and activities of inspection in the Planning and Investment sector.

According to Decree No. 216/2013/ND-CP of Vietnam’s Government, contents of specialized inspection in the field of domestic investment, foreign investment, and overseas investment are specified as follows:

- Inspection of compliance with regulations on domestic investment, foreign investment, including: Investment promotion activities; Registration, appraisal, issuance, adjustment, and revocation of investment certificates; Compliance with regulations stated in the investment certificate.

- Inspection of compliance with regulations on overseas investment, including:

+ Registration, appraisal, issuance, adjustment, and revocation of investment certificates;

+ Compliance with regulations stated in the investment certificate.

- Inspection of compliance with other regulations on domestic investment, foreign investment, and overseas investment as stipulated by the law.

Moreover, Decree No. 216/2013/ND-CP also stipulates contents of specialized inspection in the reception, management, and utilization of official development assistance (ODA), concessional loans from donors, and non-governmental foreign aid, specifically as follows:

- Inspection of compliance with regulations in the management and organization of the implementation of programs and projects utilizing ODA, concessional loans from donors, and non-governmental foreign aid within the authority.

- Inspection of compliance with regulations in monitoring and evaluating programs and projects; implementation of reporting systems and provision of information regarding programs and projects utilizing ODA, concessional loans from donors, and non-governmental foreign aid within the authority.

- Inspection of compliance with other regulations as stipulated by the law in the management and utilization of ODA, concessional loans from donors, and non-governmental foreign aid within the authority.
