Vietnam: Contents of administrative procedure control in the national defense sector

According to Circular No. 92/2015/TT-BQP of the Ministry of Defense of Vietnam, administrative procedure control in the military and national defense sector includes the following contents:

- Assessing the impact of administrative procedures and providing feedback on the regulations regarding administrative procedures in draft legislative documents.

- Coordinating the appraisal of regulations on administrative procedures; implementing the resolution of administrative procedures; inspecting and disseminating information about administrative procedure control activities.

- Publishing newly issued, revised, supplemented, replaced, abolished, and canceled administrative procedures.

- Publicly disclosing administrative procedures on the National Database, the Ministry of Defense's Electronic Information Portal, regarding administrative procedures within the jurisdiction of agencies, units, and individuals under the Ministry of Defense.

- Reviewing and evaluating administrative procedures; receiving and addressing feedback and suggestions on administrative regulations within the scope of state management functions of the Ministry of Defense.

Besides, Circular No. 92/2015/TT-BQP also stipulates that the funding provisions for administrative procedure control are from the following sources:

- Funding for administrative procedure control activities of agencies and units is ensured in the annual budget estimates of the respective agencies and units. Other funding sources provided by the State and the Ministry of Defense for legislative activities also contribute to the funding for administrative procedure control.

- Annually, based on the workload related to their functions, tasks, and authorities, agencies and units prepare budget estimates for the funding of administrative procedure control within the overall budget of the respective agencies and units. The management, use, and settlement of these funds are in accordance with the regulations stated in Circular No. 167/2012/TT-BTC dated October 10, 2012, issued by the Ministry of Finance, which regulates the budget estimates, management, and use of funds for the implementation of administrative procedure control activities, as well as the regulations of the Ministry of Defense.
