On July 1, 2024, the Government Inspector General of Vietnam issued Circular 07/2024/TT-TTCP which stipulates the authority and content for inspecting the responsibilities in implementing laws on inspections, citizen reception, complaints, denunciations, and anti-corruption.
(1) Contents of state management in anti-corruption work
- Drafting legal documents, programs, and anti-corruption work plans;
- Propagating, disseminating, and educating on anti-corruption laws;
- Implementing policies on information and reporting anti-corruption work.
(2) Implementing regulations on preventing corruption
- Publicizing and ensuring transparency in the organization and activities of agencies, organizations, and units;
- Establishing and implementing standards, norms, and policies;
- Enforcing codes of conduct for officials with positions and authority;
- Rotating officials with positions and authority;
- Implementing administrative reforms, applying science and technology in management, and non-cash payments.
(3) Implementing regulations on asset and income control
- Organizing asset and income declarations; publicizing asset and income declaration forms;
- Managing and updating asset and income declarations, and information on asset and income control; monitoring changes in the assets and income of those obligated to declare;
- Verifying assets and income and publicizing verification conclusions on assets and income;
- Protecting, storing, exploiting, and providing information on asset and income control;
- Taking actions against those who violate the obligation to honestly declare assets and income and explain the origin of increased property and income; violations of the deadline for declaring assets and income, and other violations of regulations on asset and income control;
- Building and managing a national database on asset and income control.
(4) Detecting corruption
- Detecting corruption through inspection and self-inspection work;
- Detecting corruption through handling complaints, denunciations, and reports on corrupt behavior;
- Detecting corruption through inspection work.
(5) Handling corruption
- Handling those who commit corruption acts;
- Recovering corrupt assets;
- Addressing other acts violating anti-corruption laws.
(6) Handling the responsibility of the heads of agencies, organizations, and units in anti-corruption.
(7) Implementing inspection conclusions, audit reports, handling decisions, and adhering to directives from higher authorities on anti-corruption work.
(Article 13 Circular 07/2024/TT-TTCP)
(1) Contents of state management in inspection work
- Advising, drafting, promulgating, and guiding the implementation of regulations on the organization and activities of inspections within authorized jurisdiction (if applicable);
- Implementing the responsibilities of heads of state management agencies and heads of inspection functional agencies as stipulated in the Law on Inspections of Vietnam;
- Implementing policies on information and reporting;
- Setting up, managing, exploiting, using, and storing inspection files and other related contents as prescribed by the inspection law.
(2) Inspection activities
- Organizing and drafting inspection plans, promulgating inspection plans, and executing inspection plans;
- Executing the duties and powers of the decision-maker of the inspection, the head of the inspection team, and other members of the inspection team during the inspection process;
- Executing the authority to issue inspection decisions; drafting and approving inspection implementation plans; complying with inspection duration; adhering to inspection procedures; reporting inspection results; concluding inspections, publicizing inspection conclusions; handling violations related to inspections, and monitoring, urging, and checking the implementation of conclusions, recommendations, and handling decisions related to inspections;
- Supervising the activities of the inspection team, assessing draft inspection conclusions;
- Executing the responsibilities of the heads of state management agencies at the same level in issuing documents to implement inspection conclusions and directing the implementation of inspection conclusions; handling or requesting and recommending authorized state agencies to handle economic violations; handling or requesting and recommending authorized state agencies to handle acts of violation by officials and public employees; applying or requesting and recommending authorized state agencies to apply remedial measures and improving mechanisms, policies, and laws.
