Vietnam: Conditions for recognition as revolutionary martyrs

Revolutionary martyrs are persons sacrificing themselves for national liberation revolution, national defense and fulfillment of international duties or for the State’s interests and people’s benefits and awarded the “Tổ quốc ghi công” certificate.

According to the Ordinance on preferential treatment given to people with meritorious services to the revolution 2005 of Vietnam, persons recognized as revolutionary martyrs are persons sacrificing themselves who have:

- taken part in fighting or directly served for fighting;

- directly carried out political struggle, agitation and propaganda among enemy troops;

- been captured and have suffered torture by the enemy during revolutions or resistance wars but not surrendering and sacrificing himself/herself during prison-break;

- fulfilled international duties;

- fought against offenders;

- bravely performed urgent and dangerous tasks serving national defense and security; saved people’s life and assets of the State and people;

- suffered from diseases or accidents during performance of their duties of national defense and security in the area with severely poor socio-economic conditions;

- War invalids or persons entitled to incentive policies like war invalids specified in Clause 1 and 2 Article 19 of this Ordinance who died from illness relapse.

Revolutionary martyrs shall have their death notified and shall be buried and commemorated. The State and people shall construct, manage and maintain citation works for revolutionary martyrs such as graves, graveyards and monuments.

The following cases are not subject to recognition as revolutionary martyrs:

- Cases of death caused by themselves or due to violations of the law, violations of regulations of agencies and units;

- In cases of death from December 31, 1994 or earlier, the competent authority concludes that there are no conditions for certifying martyrs or has reported death under the martyrdom regime, or soldiers have died or have had an occupational accident.

Legal bases: Ordinance on preferential treatment given to people with meritorious services to the revolution 2005 of Vietnam, Decree No. 31/2013/NĐ-CP of Vietnam’s Government.
