Vietnam: Conditions for applying competitive offering

On May 11, 2016, the Ministry of Health of Vietnam issued Circular No. 11/2016/TT-BYT, which specifies the conditions for applying competitive offering.

According to Circular No. 11/2016/TT-BYT of the Ministry of Health of Vietnam, competitive offering shall be applied when all of the conditions below are satisfied:

- The procurement value does not exceed 05 billion VND;

- The drug to be procured is on the List of essential medicines promulgated by the Ministry of Health or a commonly available drug whose technical characteristics and quality have been standardized and equivalent;

- There is a contractor selection plan approved by the competent person;

- If the procurement is funded by the state budget, it is required to have an approved cost estimate. If the procurement is funded by another funding source, it must be sufficient to pay for the procurement on schedule.

More details can be found in Circular No. 11/2016/TT-BYT of the Ministry of Health of Vietnam, which takes effect from July 01, 2016.
