Vietnam: Competence to appoint officials officials to leadership and management positions shall comply with the regulations of the Party Committee

Specifically, according to Article 43 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, responsibilities in appointing officials to leadership and management positions are specified as follows:

- The head, members of the committee, leaders of agencies and organizations are responsible for proposing personnel and commenting and evaluating the proposed personnel.

- Collectively at all levels of Party committees and leaders of agencies or organizations, discuss, comment, evaluate, decide or request competent authorities for consideration and decision.

- Individuals and collectives who propose to appoint must be responsible before competent authorities for their suggestions, comments, evaluations and conclusions on political standards, moral qualities and lifestyles; working capacity, advantages and disadvantages for the personnel proposed to be appointed.

- The agency advising on personnel organization and relevant agencies shall be responsible for the results of the appraisal and recommendation of personnel according to their functions, tasks and powers.

- The leadership collective, the head of the appointment decision is responsible for his/her decision; leading and directing the inspection, supervision and handling of violations on personnel work.

- Officials proposed or considered for appointment must be responsible for declaring their background, personal records, declaring their assets and income, and explaining related contents.

Note: Competence to appoint officials officials to leadership and management positions is as follows:

- For positions under the Politburo, the Secretariat manages and appoints authority according to the Politburo's regulations on officials management decentralization.

- For other leadership and management positions, the appointing authority shall comply with regulations on decentralization of officials management of Party committees at all levels.
