Vietnam: Commodities traded through commodity exchanges

Nowadays, the performance of commercial activities through the Commodity Exchange is increasing day by day, so there is a need for a reasonable mechanism to regulate activities at the Commodity Exchange in Vietnam.

Decree No. 51/2018/NĐ-CP of Vietnam’s Government provides amendments to some articles of Decree No. 158/2006/ND-CP elaborating the Commercial Law with respect to trading in commodities through commodity exchanges.

According to Decree No. 51/2018/NĐ-CP of Vietnam’s Government, commodities traded through commodity exchanges are specified as follows:

1. Regarding the commodities on the list of commodities subject to conditional business and limited to business, the commodity exchange shall register with a competent authority so that such commodities can be listed on the commodity exchange.

2. Regarding the commodities that are not on the list of commodities banned from business, limited to business and subject to conditional business, the commodity exchange shall submit notice documentation to inform the Ministry of Industry and Trade at least 30 days before such commodities are officially listed on the commodity exchange.

The notification documentation includes:

- A written notice of listing new commodities on the commodity exchange;

- Documents that describe the contract on each commodity expected to be listed on the commodity exchange.
