This is an important content of Circular No. 22/2020/TT-BTC of the Ministry of Finance of Vietnam on fees for mining and use of environmental data and collection, transfer, management and use thereof.
Specifically, according to Circular No. 22/2020/TT-BTC of the Ministry of Finance of Vietnam, the fee collector that is a public service provider may retain 70% of the total amount of collected fees in order to cover its costs in accordance with regulations in Article 5 of Decree No. 120/2016/NĐ-CP dated August 23, 2016 of Vietnam’s Government detailing and guiding the implementation of a number of articles of the Law on fees and charges. The remaining amount (30%) must be transferred to the state budget as prescribed.
Besides, Circular No. 22/2020/TT-BTC stipulates that the fee collector, which is a regulatory agency, shall transfer 100% of the collected fees to the state budget. Budget for data provision and fee collection shall be included in the fee collector's estimate according to the policies and limits on State budget expenditures.
Fees for mining and use of environmental data are provided in the Schedule of fees promulgated together with Circular No. 22/2020/TT-BTC.
Note: Fees for mining and use of environmental data that are effective from May 26, 2020 to December 21, 2020 inclusive are 70% of those specified in the Schedule of fees promulgated together with this Circular.
