Vietnam: Charge for licensing of the exportation of workers

On November 11, 2016, the Minister of Finance of Vietnam issued Circular No. 259/2016/TT-BTC on the rate, collection, submission, administration and use of the fee for verification of documents and the charge for licensing of the exportation of workers on a fixed-term basis.

According to Circular No. 259/2016/TT-BTC of the Ministry of Finance of Vietnam, payers are companies, organizations and individuals upon applying to competent government authorities for verification of the documents concerning Vietnamese workers taking up overseas employment and companies and organizations upon the issuance, replacement or re-issuance of their license for exporting workers on contract basis. The Department of Overseas Labour (Ministry of Labour, Invalids and Social affairs) and Vietnam’s overseas missions shall collect the fee and charge defined in this Circular.

According to Circular No. 259/2016/TT-BTC of the Ministry of Finance of Vietnam, the charge for licensing of the exportation of workers on fixed-term basis is VND 5,000,000/time; and VND 2,500,000/time in case of replacement or reissuance.

Fee for verification of documents upon request of an overseas employer of Vietnamese workers is TWD 1,000/application (in Taiwan); MYR 100/document (in Malaysia).

Fee for verification of documents of employees working in Taiwan and Japan is VND 100.000/application.

Moreover, Circular No. 259/2016/TT-BTC also stipulates that individuals from poor and near-poor households, and permanent residents from ethnic minority groups in economically and socially underdeveloped communes shall be exempt from the fee for verification of documents upon request of local persons working in Taiwan or Japan.

Circular No. 259/2016/TT-BTC also stipulates that overseas missions of Vietnam shall submit 70% the fee amount collected in the previous month into the temporary state budget fund and transfer 30% of the amount collected in the previous month into their checking account at the State Treasury.

The Department of Overseas Labour shall submit the entire fee amount that it has collected and the fee amount transferred from the overseas missions of Vietnam into the state budget.

Circular No. 259/2016/TT-BTC of the Ministry of Finance of Vietnam came into force from January 01, 2017, replacing Circular No. 37/2016/TT-BTC.
