Vietnam: Cases that learners under the recruitment regime must reimburse the training costs

This is a notable content of the Decree No. 141/2020/NĐ-CP of the Government of Vietnam on regulations on the recruitment regime for pupils and students of ethnic minorities, issued on December 08, 2020.

According to Article 13 of the Decree No. 141/2020/NĐ-CP of Vietnam’s Government, learners under the recruitment regime in one of the following cases must reimburse scholarships and training expenses:

1. Persons who voluntarily withdraw from school or are disciplined to withdraw from school, except for cases of self-exclusion due to force majeure.

2. Persons who do not comply with the recruitment examination and job arrangement after graduation as committed.

3. Persons whose working time after graduation according to the job position assigned by the People's Committee of the province is less than twice the duration of the scholarship and training expenses.

4. The disciplined person quits his job while he is serving the obligation to work under the assignment.

Reimbursement costs and how to calculate reimbursement costs are as follows:

- Reimbursement costs include: scholarships and training expenses that have been allocated by the state budget to learners under the recruitment regime.

- How to calculate reimbursement costs:

+ For the cases specified in Clauses 1 and 2 Article 13 of Decree No. 141/2020/NĐ-CP, the calculation of reimbursement costs is calculated according to the following formula:

S = (HB+CF) x N

Where:

  • S is the reimbursement cost;

  • HB is the scholarship that learners enjoy for one month;

  • CF is the cost of training learners in a month;

  • N is the time the learner has studied under the election system, calculated by rounded months.

+ For the cases specified in Clauses 3 and 4 Article 13 of Decree No. 141/2020/NĐ-CP, the calculation of reimbursement costs is calculated according to the following formula:

S = [(T - t)/ T] x [(HB+CF) x N]

Where:

  • T is the number of months the nominator has to fulfill the duty to work under the assignment;

  • t is the number of months the nominator has worked under the assignment;

  • Symbols: S, HB, CF and N are determined as above.

Note: Within 60 days from the date of receiving the decision of the competent state agency, the candidate is responsible for paying the full amount to be reimbursed.

In case the learner fails to fulfill the reimbursement obligation, the state agency competent to decide on reimbursement may initiate a lawsuit in accordance with law.
