This is a notable content of the Decree No. 77/2017/NĐ-CP of Vietnam’s Government on management and protection of security at port checkpoints.
Specifically, according to Clause 4 Article 20 of the Decree No. 77/2017/NĐ-CP of Vietnam’s Government, carry out on-board inspection and supervision if:
- The vessel carries foreign tourists;
- The vessel or people thereon commit violations against regulations of law on immigration and security. If the vessel or people thereon commit violations against regulations of law on customs, maritime and epidemic prevention and control, the port border guard shall conduct on-board inspection and supervision at the request of state authorities responsible for port management;
- There is a stowaway;
- There is proof of wrong declaration on the vessel, seamen or passengers;
- The inspection and supervision of the vessel need to be carried out upon the request of the shipowner or the shipmaster;
- Leader of the port border guard station and head of port border guard shall make a decision on carrying out on-board inspection and supervision and take responsibility for their decision.
