Vietnam: Can people having bad ID card photos change their ID cards?

The people’s identity card (ID card) is an indispensable identification document for anyone and is often used a lot in life, however, some people have bad photos of their ID cards, so they often feel guilty when presenting these documents. Do they have the right to change their ID cards?

Pursuant to Clause 1 Article 5 of Decree No. 05/1999/NĐ-CP of Vietnam’s Government, the following cases must go through procedures for change of the people’s ID cards:

1. The following cases must go through procedures for change of the people’s identity cards:

a/ The people’s ID card has expired;

b/ The people’s ID card is damaged and unusable;

c/ There is a change in the family name, given name, middle name, day, month and/or year of birth;

d/ The permanent residence registration place has changed to outside the province or centrally-affiliated city;

e/ There is a change to the identification particulars.

Based on the above regulations, people with bad ID card photos are not eligible to change their ID card, concurrently, if a person arbitrarily changes his/her ID card photo, he/she may also be fined for erasing or modifying his/her ID card as prescribed in Point a Clause 2 Article 9 of Decree No. 167/2013/NĐ-CP of Vietnam’s Government with a fine of VND 1,000,000 - VND 2,000,000.

If the person having a bad ID card photo still feels uncomfortable and does not want to use his/her ID card in daily tasks, he/she can carry out the procedure for issuing a citizen ID card according to the provisions of the Law on Citizen Identification 2014 of Vietnam.
