Recently, the Government of Vietnam issued Decree 103/2007/ND-CP stipulating the responsibilities of heads of agencies, organizations, units and the responsibilities of Vietnamese officials and public employees in thrift and wastefulness prevention.
Vietnam: Basis for disciplinary actions against violations related to thrift and wastefulness prevention (Illustration)
Article 17 Decree 103/2007/ND-CP stipulates the basis for disciplinary actions against violations related to thrift and wastefulness prevention in Vietnam as follows:
1. Basis for considering disciplinary action against the head of an agency, organization, or unit for violations against regulations on thrift and wastefulness prevention in the agency, organization, or unit under their management and responsibility:
- Allocation, management decentralization, nature, and extent of the violations, actual damage caused by the wastefulness; aggravating or mitigating circumstances of disciplinary action to determine the extent of direct or joint responsibility when violations against regulations on thrift and wastefulness prevention occur;
- The working relationship between the violations against regulations on thrift and wastefulness prevention by subordinates and the management responsibility of the head.
2. Basis for considering disciplinary action against officials and public employees who commit violations against regulations on thrift and wastefulness prevention in an agency, organization, or unit:
Allocation of tasks, duties, powers, nature, and extent of the violations, actual damage caused by the wastefulness, aggravating or mitigating circumstances of disciplinary action to determine the extent of responsibility of officials and public employees in case of violations against regulations on thrift and wastefulness prevention.
3. In cases where violations against regulations on thrift and wastefulness prevention show signs of constituting criminal acts, the competent authority shall transfer the dossier to the investigative agency for handling in accordance with the law.
