Vietnam: Authorization for assignment or permission of sending official abroad must be made in writing

This is a notable content specified in Circular No. 04/2020/TT-BNG on guidelines for the issuance, renewal or revocation of diplomatic or official passports, and issuance of diplomatic notes requesting visas from foreign countries, issued on September 25, 2020 by the Ministry of Foreign Affairs of Vietnam.

According to Article 5 of Circular No. 04/2020/TT-BNG of the Ministry of Foreign Affairs of Vietnam, authorization for assignment or permission of sending official abroad is prescribed as follows:

- The authorization granted to the head of affiliated entities for overseas assignment or permission under clause 11 Article 11 of the Law must be made in writing using the Form No. 04/2020/NG-XNC hereto appended.

- The written authorization must bear the signature of the head or deputy head of the authority specified in clauses 1 through 10 Article 11 of the Law (hereinafter referred to as sending authority) and the seal of the sending authority. If the principal of the letter of authorization reaches the end of his term of office, the successor must be issued with a new letter of authorization. If the letter of authorization is an electronic document, it must comply with regulations of law on digital signatures and e-documents.

If the regulation on management of sending officials abroad of the sending authority prescribed in Article 11 of the Law has stipulated the authorization or authorized the head of affiliated entity to send officials abroad through assignment or permission, this affiliated entity is not required to issue a letter of authorization; the affiliated entity must submit a letter of introduction of signature of the authorized person to the local issuing authority as prescribed in Article 6 of this Circular.
