Recently, the Ministry of Home Affairs of Vietnam issued Circular 03/2008/TT-BNV guiding the consideration of grade promotion without examination for officials and public employees who have received retirement notices.

Circular 03/2008/TT-BNV stipulates the authority to review and decide on grade promotion without examination upon retirement notice in Vietnam as follows:
1. Regarding the appointment to the principal specialist grade and equivalent:
- For state agencies: Ministers, Heads of ministry-level agencies, agencies under the Government of Vietnam, Chairman of the People's Committee of provinces and centrally-run cities (hereinafter collectively referred to as ministries, central and local authorities) shall, based on the application for consideration for grade promotion, issue a decision on appointment to the principal specialist grade and grading of salary for officials in agreement with the proposing agency.
- For public service providers: Agencies and units delegated the authority to appoint to specialized public employee grades equivalent to principal specialist grade shall, based on the application for consideration for grade promotion, report to ministries, central and local authorities for review and consensus in agreement with the proposing agency. After that, the delegated agency or unit will issue a decision on appointment to the principal specialist grade and grading of salary for public employees considered for promotion.
2. Regarding the appointment to the senior specialist grade and equivalent: Agencies and units with authority over officials and public employees shall submit a written proposal (including a relevant application) to the Ministry of Home Affairs for review and decision.
