Vietnam: Assurance of equal participation of legal aid-providing persons

Recently, the Ministry of Justice of Vietnam issued Circular 11/2014/TT-BTP on the assurance of gender equality in legal aid.

Under Article 10 of Circular 11/2014/TT-BTP, the assurance of equal participation of legal aid-providing persons in Vietnam is specified as follows:

1. Legal aid-providing organizations in Vietnam assign legal aid-providing persons to implement measures for the protection and assistance of legally aided persons who are mothers, female children, domestic violence victims, victims of trafficking, and victims of sexual abuse in accordance with the needs of the legally aided persons and the capabilities of the organization.

2. Legal aid-providing organizations publicly disclose the list of their legal aid-providing persons so that legally aided persons can exercise their rights to select and change legal aid-providing persons. The list of legal aid-providing persons must clearly indicate gender, areas of expertise, and work experience in the assigned specialized fields.

3. Female legal aid-providing persons who are raising children under 36 months old are assigned legal aid cases suitable to their abilities and conditions. Legal aid-providing organizations are responsible for assisting and facilitating favorable conditions for them during the provision of legal aid.
