Recently, the Government of Vietnam issued Decree 94/2009/ND-CP on elaboration of Law on prevention and control of narcotic substances regarding post-rehabilitation management in Vietnam.
Vietnam: Application for taking post-rehabilitation management at the residence (Illustrative image)
Under Article 6 of Decree 94/2009/ND-CP, 45 days before the end of the mandatory rehabilitation period, the Director of the Social-Education-Labor Center in Vietnam is responsible for preparing an application for taking post-rehabilitation management at the residence. The application includes:
- Dossier of the person undergoing rehabilitation at the Social-Education-Labor Center (copy);
- Comments and assessment of the Director of the Social-Education-Labor Center on the process of study and training of the drug addict at the Center;
- Written request for taking post-rehabilitation management of the Director of the Social-Education-Labor Center;
- Documents proving that the person undergoing rehabilitation falls under the category of post-rehabilitation management at the residence.
At the same time, the Director of the Social-Education-Labor Center is responsible for transferring the application to the Head of the Division of Labor-War Invalids and Social Affairs where the application was prepared to bring the person undergoing rehabilitation into the Social-Education-Labor Center no later than 20 days before the person finishes the mandatory rehabilitation period.
Within five days from the date of receiving the application, the Head of the Division of Labor-War Invalids and Social Affairs is responsible for verifying and preparing a document for submission to the Chairman of the District People's Committee.
Within 05 days from the date of receiving the document from the Head of the Division of Labor-War Invalids and Social Affairs, the Chairman of the District People's Committee shall decide on taking post-rehabilitation management at the residence and notify the list of persons under post-rehabilitation management to the Commune People's Committee where the drug addict resides to have a plan for reception and implementation of post-rehabilitation management.
