Decree No. 106/2017/NĐ-CP provides amendments to Decree No. 67/2013/ND-CP of Vietnam’s Government elaborating certain articles and measures for implementing the Law on Tobacco Harm Prevention and Control with respect to tobacco trading.
Decree No. 106/2017/NĐ-CP of Vietnam’s Government supplements application and procedures for non-commercial import of tobacco as follows:
- Individuals that enter Vietnam may bring tobacco as long as it does not exceed the limits on luggage according to the regulations of the Government.
- Diplomatic missions, consular offices, and international organizations in Vietnam must comply with Vietnam’s law when they are allowed to import tobacco for use.
- An enterprise that is granted the License to manufacture tobacco products and wishes to import tobacco into Vietnam to serve its research and experimental production activities must submit an application by hand or by post or through the internet network to the Ministry of Industry and Trade. The application includes:
+ The application for approval for import of tobacco.
+ Documents proving the origin of imported tobacco samples.
Within 07 working days from the receipt of a valid application, the Ministry of Industry and Trade shall consider the application and give a written response to the applicant. If an application is refused, the written response shall specify reasons for refusal.
The quantity of imported tobacco serving research and experiment production must not exceed 500 packs (20-cigarette pack) or 50 cigars.
