Vietnam: All criteria and conditions for appointment of leading and managerial officials

This is an important content of the Decree No. 138/2020/NĐ-CP of the Government of Vietnam on recruitment, employment and management of officials, issued on November 27, 2020.

Specifically, according to Article 42 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, criteria and conditions for appointment of leading and managerial officials include:

- Ensure the general standards, title criteria according to the regulations of the Party and State and the specific standards of the appointed positions according to the regulations of the competent agencies.

- Must be planned for the appointed position if he/she is an on-site personnel or an equivalent position if he/she is a personnel from another place. In case the newly established agency or organization has not yet approved the planning, it shall be considered and decided by a competent authority.

- Having a verified personal profile, and a declaration of assets and income as prescribed.

- Conditions of appointment age:

+ Officials who are proposed to be appointed for the first time holding a leadership or management position or request for appointment to a higher leadership or management position, the appointment age must have full 05 years of working from the date of implementation of the appointment process; special cases must be reported to competent authorities for consideration and decision;

+ For officials who are proposed to be appointed to a leadership or management position for which the term of each appointment is less than 5 years as prescribed by specialized laws and competent agencies, the age for appointment must be full one term;

+ Officials who are transferred or appointed to hold a new position equivalent to or lower than the current one, the appointment age shall not be counted as prescribed at Point a of this Clause.

- Have enough health to complete assigned tasks and responsibilities.

- Not falling into the cases of being banned from holding certain positions according to the Party's regulations and laws; not within the time limit for disciplinary action, not within the time of implementing the provisions related to discipline specified in Article 82 of the Law on Officials amended by Clause 17 Article 1 of the Law on Amendments to the Law on Officials and Public Employees of Vietnam.
