Vietnam: Advertising message requirements, tagging and option to unsubscribe from advertising messages

This is a notable content of the Decree No. 91/2020/NĐ-CP of Vietnam’s Government on fighting spam messages, spam emails and spam calls, effective from October 01, 2020.

According to Article 14 of the Decree No. 91/2020/NĐ-CP of Vietnam’s Government, advertising message requirements are as follows:

- Advertising messages shall be tagged in accordance with regulation.

- Advertisements of charged services shall specify the charges.

- Recipients have the option to refuse in accordance with regulation.

Besides, according to Article 15 of the Decree No. 91/2020/NĐ-CP of Vietnam’s Government, tagging advertising messages is as follows:

- All advertising messages shall be tagged.

- The tag shall be placed at the beginning of the message.

- The tag shall be [QC] or [AD].

Concurrently, according to Article 16 of the Decree No. 91/2020/NĐ-CP of Vietnam’s Government, option to unsubscribe from advertising messages is as follows:

- The user’s option to unsubscribe from advertising messages shall:

+ be clearly displayed at the end of the advertising message;

+ instruct the user to unsubscribe from advertising messages to which the user previously subscribed;

+ allow the user to reject a specific product or group of products where necessary; and

+ contain clear instructions on how to unsubscribe and the unsubscribing methods as prescribed.

- The unsubscribing request can be made by:

+ sending a message; or

+ making a call.

Moreover, right after the user’s unsubscribing request, the advertiser shall send a confirmation and stop sending the refused type of advertising messages to the user.

Note: The confirmation shall:

- clearly state that the unsubscribing request has been received, time of receipt of the request and stopping sending advertising messages;

- be successfully sent once and does not contain any advertisement.
