Vietnam: A written reply must be given to the applicant which clearly states reason of refusal if diplomas are not eligible for recognition

This is an important content stipulated in Circular 26/2013/TT-BGDDT amending a number of articles of regulation on orders of and procedures for recognizing diplomas granted to Vietnamese by foreign educational institutions promulgated together with Decision 77/2007/QD-BGDDT issued by the Minister of Education and Training on July 15, 2013.

Clause 1, Article 1 of Circular 26/2013/TT-BGDDT stipulates the amendments to Point b, Clause 2, Article 5 of Decision 77/2007/QD-BGDDT as follows:

- After receiving full and valid dossier, the Education Quality Examination and Accreditation Bureau (the Ministry of Education and Training) shall issue a receipt to the applicant (Form No. 2 enclosed); if the dossier is sent by post, the date on postmark is used as the date of receipt of the dossier. Within 30 working days, on the basis of regulation on enrollment, training program, system of diplomas of countries where grant diplomas, the Education Quality Examination and Accreditation Bureau shall coordinate with concerned units in considering and recognizing diplomas to be suitable with one of diplomas of Vietnam specified in Clause 2 Article 1 of the Decision No. 77/2007/QD-BGDDT dated December 20, 2007 of the Minister of Education and Training (Form No. 4 enclosed).

- If diplomas that are requested for recognition are not suitable with one of diplomas of Vietnam, the Education Quality Examination and Accreditation Bureau shall give a written reply to the applicant for supplying additional information and recognition of actual value of diplomas in the educational system of countries where grant diplomas.

- If diplomas are not eligible for recognition, the Education Quality Examination and Accreditation Bureau shall give a written reply to the applicant which clearly states reason of refusal.

Above are regulation on the order and procedures for recognizing diplomas for  diplomas of graduation from professional intermediate schools, college graduation diplomas; university graduation diplomas; master diplomas; and doctoral diplomas.

* For diplomas of graduation from different general-education levels:

- The diploma holder, his/her representative at law or authorized person who applies for recognition of diplomas granted by a foreign educational institution shall send two (02) sets of dossier specified in Article 6 of this Document to the provincial/ municipal Education and Training Service;

- After receiving a complete and valid dossier, the provincial/municipal Education and Training Service shall issue a receipt to the applicant (Form No. 2 enclosed with this Decision, not printed herein); if the dossier is sent by post, the date on postmark is used as the date of receipt of the dossier. Within 15 working days, the dossier-receiving agency shall consider and recognize diplomas of the applicant (Form No. 3 enclosed with this Decision, not printed herein). If diplomas are not recognized, the dossier-receiving agency shall give a written reply to the applicant.

More details can be found in Circular 26/2013/TT-BGDDT, which comes into force from August 30, 2013.
