On December 24, 2013, the Government of Vietnam issued Decree No. 216/2013/ND-CP on the organization and activities of inspection in the Planning and Investment sector.
According to Decree No. 216/2013/ND-CP of Vietnam’s Government, 16 duties and powers of the Inspectorate of the Ministry of Planning and Investment are specified as follows:
1. Developing inspection plans and submitting them to the Minister for approval; organizing the implementation of inspection plans under the responsibility of the Ministry's Inspectorate; providing guidance, monitoring, urging, and inspecting the implementation of inspection plans by the specialized inspection agency under the Ministry.
2. Guiding the specialized inspection tasks for the specialized inspection agency under the Ministry, provincial Inspectorates; guiding and inspecting the compliance with the regulations on inspection by the agencies, organizations, and individuals under the management scope of the Ministry.
3. Requesting the head of the specialized inspection agency under the Ministry to report on the inspection work; summarizing and reporting the results of the inspection work within the management scope of the Ministry.
4. Monitoring, urging, and inspecting the implementation of conclusions, recommendations, and decisions on inspection by the Minister, Ministry's Inspectorate.
5. Inspecting the implementation of policies, laws, duties, and powers of agencies, organizations, and individuals under the direct management of the Ministry; inspecting state-owned enterprises established by the Minister.
6. Inspecting compliance with specialized laws, regulations on professional and technical expertise, management rules of the sector, and field of the agencies, organizations, and individuals under the management scope of the Ministry.
7. Inspecting other cases assigned by the Minister.
8. Checking the accuracy and legality of inspection conclusions and post-inspection decisions by the head of the specialized inspection agency under the Ministry, the Chairman of the provincial People's Committee regarding cases within the sector and field of state management of the Ministry when necessary.
9. Assisting the Minister in managing the settlement of complaints and denunciations; implementing the task of handling complaints and denunciations as prescribed by the laws on complaints and denunciations.
10. Assisting the Minister in managing the prevention and control of corruption; implementing the task of prevention and control of corruption as prescribed by the laws on anti-corruption.
11. Collecting information to develop annual inspection plans; guiding the provincial Inspectorate of Planning and Investment in developing specialized inspection plans.
12. Inspecting and urging the construction and implementation of the specialized inspection plan of the Inspectorate of the Department of Planning and Investment.
13. Organizing training on specialized inspection skills for inspectors and officials involved in inspection work under the Ministry of Planning and Investment.
14. Disseminating, guiding, inspecting, and urging the agencies and units under the Ministry of Planning and Investment to comply with the regulations and laws on inspection.
15. Summarizing and drawing lessons from inspection work within the delegated and authorized scope of state management of the Ministry of Planning and Investment.
16. Other duties and powers as prescribed by law.
