Vietnam: 12 contents of management of officials according to Decree No. 138/2020/NĐ-CP

Specifically, according to Article 71 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, contents of management of officials include:

1. Promulgating legal documents on officials.

2. Planning on officials.

3. Regulating ranks, titles and codes of officials; employment position and structure of officials.

4. Determining the number and managing the payroll of officials.

5. Organizing the recruitment and employment of officials.

6. Organizing and implementing training and retraining regimes for officials.

7. Organizing the implementation of the salary regime and the regimes and treatment policies for officials.

8. Organizing the commendation and disciplining of officials.

9. Implementing the severance and retirement regimes for officials.

10. Implementing the regime of reporting, statistics and management of officials records.

11. Inspecting and examining the implementation of the provisions of the law on officials.

12. Directing and organizing the settlement of complaints and denunciations against officials.

Besides, according to Article 72 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, the Ministry of Home Affairs is answerable to the Government for performing the state management of officials and has the following duties and powers:

- Elaborate draft laws and ordinances on officials for the Government to submit to the National Assembly and the National Assembly Standing Committee;

- Formulate and submit to the Government and Prime Minister regulations on strategies, plans, plannings and programs on development of the contingent of officials; assign and decentralize management of officials and officials payrolls; employment position and structure of officials; strategies and plans for training and fostering the contingent of officials; salary regime and other policies and remuneration for officials; policies towards talented people; title standards and selection of officials holding leadership and management positions in state administrative agencies; appointment, re-appointment, transfer, rotation, secondment, resignation, relief from duty, commendation, discipline, termination or retirement of officials;

- Guide and inspect the observance of the provisions of the law on titles, standards of officials ranks, and structure of officials ranks; promulgate and guide and inspect the implementation of regulations on officials recruitment examination, officials recruitment examination, regulations on organization of officials rank promotion exam, officials recruitment exam rules, officials recruitment examination and officials rank promotion exam, assessment of officials, training programs according to the standards of officials ranks, training and retraining programs according to the standards of positions and titles of leading and managerial officials;

- Regulate making records, managing records; officials number; codes of state administrative agencies; officials card;

- Manage the number and structure of officials ranks;

- Give opinions to the officials management agency on rank appointment and salary arrangement for officials with the rank of senior specialist or equivalent;

- Guide and organize statistics for the contingent of officials throughout the country; build and manage national data on the contingent of officials;

- Guide and organize the implementation of the reporting regime on the management of officials;

- Inspect, examine and supervise the implementation of the provisions of the law on officials;

- Settle complaints and denunciations against officials according to decentralization and according to the provisions of law on complaints and denunciations.
