Vietnam: 10 duties and powers of the Inspectorate of the Ministry of Natural Resources and Environment

On July 16, 2013, the Government of Vietnam promulgated Decree 35/2009/ND-CP on the organization and operation of the Inspectorate of Natural Resources and Environment.

According to Article 10 Decree 35/2009/ND-CP stipulating 10 specific duties and powers of the Inspectorate of the Ministry of Natural Resources and Environment in Vietnam as follows:

  1. Perform administrative and specialized inspection duties and powers as stipulated in the Law on Inspection.

  2. Impose administrative penalties according to regulations on handling administrative violations.

  3. Host or participate in drafting legislative documents to submit to the Minister of Natural Resources and Environment.

  4. Propose competent authorities to amend, supplement, or issue legislative documents in line with state management requirements on natural resources and the environment; propose competent authorities to suspend illegal activities of organizations and individuals when there is sufficient evidence to determine that the violation causes damage to state interests and the legitimate rights and interests of citizens; propose competent state agencies to suspend or annul documents that violate laws on natural resources and the environment; propose handling of officials who violate their duties as detected through inspection work.

  5. Monitor, inspect, and urge the implementation of conclusions, recommendations, and handling decisions related to inspection by the Inspectorate of the Ministry.

  6. Assist the Minister of Natural Resources and Environment in organizing citizen reception, and settling disputes, complaints, and denunciations according to legal regulations.

  7. Perform tasks of anti-corruption according to legal regulations.

  8. Guide the specialized inspection activities on natural resources and environment for the sub-ministerial inspectorates; guide and inspect the units under the Ministry in implementing legal regulations on inspection.

  9. Summarize and report on inspection, the settlement of complaints and denunciations, and anti-corruption within the state management by the Ministry of Natural Resources and Environment.

  10. Perform other tasks as assigned by the Minister of Natural Resources and Environment.
