Under Article 11, Decree 35/2009/ND-CP, the Chief Inspector of the Ministry of Natural Resources and Environment in Vietnam has the following 09 duties and powers:
Lead and direct inspection work within the state management of the Ministry of Natural Resources and Environment.
Develop inspection programs and plans, submit them to the Minister of Natural Resources and Environment for approval, and organize the implementation of those programs and plans; propose the Minister handle overlapping and duplication in inspection programs, plans, and contents within the state management of the Ministry of Natural Resources and Environment.
Submit to the Minister of Natural Resources and Environment for issuing inspection decisions when signs of legal violations are detected.
Submit to the Minister of Natural Resources and Environment for decision-making or decide according to authority on the establishment of inspection delegations, appoint Inspectors, and recruit inspection collaborators to conduct inspections under the legal regulations.
Recommend the Minister of Natural Resources and Environment to temporarily suspend the execution of decisions of organizations or individuals under the direct management of the Ministry of Natural Resources and Environment when there is a basis to believe that such decisions are illegal or affect inspection activities.
Impose administrative penalties as prescribed by the law on handling administrative violations.
Recommend the Minister of Natural Resources and Environment consider responsibilities and handle the heads of agencies with violations under the Minister's management authority; cooperate with the Heads of agencies and organizations in considering responsibilities and handling individuals with violations under the management authority of those agencies and organizations.
Recommend the Minister of Natural Resources and Environment resolve issues related to inspection work; if the recommendation is not accepted, report to the Chief Inspector General.
Perform other duties and exercise powers as prescribed by law.
