Vietnam: 09 duties and powers of sub-ministerial chief inspectors of natural resources and environment

Recently, the Government of Vietnam issued Decree 35/2009/ND-CP on the organization and operation of the Inspectorate of Natural Resources and Environment.

Decree 35/2009/ND-CP specifies 09 duties and powers of sub-ministerial chief inspectors of natural resources and environment:

  1. Lead and direct inspection work within the management scope of the General Department/Department.

  2. Develop inspection programs and plans and organize the implementation of programs and plans approved by the Minister of Natural Resources and Environment.

  3. Submit to the Director General/Director for issuance of inspection decisions when signs of legal violations are detected.

  4. Submit to the Director General/Director for decision or make decisions on the establishment of Inspection delegations, assign Inspectors, and mobilize Inspection Collaborators to conduct inspections within their authority according to legal regulations.

  5. Propose the Director General/Director to temporarily suspend the execution of decisions by organizations or individuals under the direct management of the General Department/Department when there are grounds to believe that the decision is illegal or affects inspection activities.

  6. Impose administrative penalties according to legal regulations on handling administrative violations.

  7. Propose the Director General/Director to review responsibility, and handle individuals violating under the Director General/Director’s management; and cooperate with Heads of agencies, and organizations in reviewing responsibility, handling individuals violating under the management of those agencies and organizations.

  8. Propose the Director General/Director to resolve issues regarding inspection work; if the proposal is not accepted, report to the Chief Inspector of the Ministry.

  9. Perform other duties and exercise other powers as prescribed by law.
