On September 04, 2018, the Government of Vietnam issued the Decree No. 114/2018/NĐ-CP on dam and reservoir safety management.
Specifically, according to Article 11 of the Decree No. 114/2018/NĐ-CP of Vietnam’s Government, reservoir operation procedures must comply with provisions of the Irrigation Law and Law on Water Resources and relevant law provisions, and is conformable to the operation procedure applied to inter-reservoirs in the river basin which is approved by the Prime Minister. Main contents of the procedures include:
1. Legal bases for establishing the procedure, operation principles, primary technical parameters and function of the reservoir;
2. Regulations on gate operation (if any); particular regulations on reservoir operation during flood season and dry season in normal circumstances and in cases of drought, water shortage, saline intrusion, flooding, water pollution and emergencies;
3. Regulations on monitoring and provision of information on dedicated hydrometeorology monitoring as prescribed in Article 15 herein;
4. Warning of flood discharge in normal circumstances and in emergencies and warning of power generation, including: regulations on time limit for warning before opening the first floodgate, warning signal, warning time, warning position, responsibilities for issuing, announcing and executing the flood discharge order and responsibilities for issuing, delivering and receiving the warning of flood discharge assigned to organizations and individuals;
5.Regulations on minimum water flow (if any);
6. Regulations on responsibilities and rights of organizations and individuals involved in adoption of reservoir operation procedures;
7. Regulations on adoption and amendment of reservoir operation procedures.
